RE: New Forms GIT/ REP-4 and GIT/REP-4a

Dear Associates:

Two new forms have been created by the Division of Taxation. Form GIT/REP-4 was created for situations in which the Division of Taxation has determined that the GIT/REP-1, -2, -3 need not be filed. In its memorandum, the Division of Taxation gave several examples of situations in which the GIT/REP-4 will be issued:

  1. Corrective or confirmatory deeds which need to be recorded due to a typographical, clerical, property description or other scrivener error and the original deed conveyance occurred prior to August 1, 2004.

  2. The title owner did not record the deed prior to October 1, 2004, where the deed is dated prior to August 1, 2004, and the seller is deceased or cannot be located.

  3. The seller is a New Jersey resident who is being relocated elsewhere in New Jersey by his or her employer, through an out-of-state relocation company which temporarily takes nominal title but has no gain on the sale to the ultimate buyer.

The Division of Taxation stated that the use of the GIT/REP-4 is not limited to these situations.

Form GIT/REP-4 must be issued by the State Division of Taxation with its raised seal. A copy of GIT/REP-4 is attached for your reference. Please call either the State Office of the Division of Taxation Customer Service Center at (609) 292-6400 if you have any questions as to its use.

A second new form, GIT/REP-4a, has also been created. It may be used in situations where you are recording a corrective or confirmatory deed due to a typographical, clerical, property description or other scrivener error, no matter when the original deed was recorded. A copy of the new form is attached for your reference. The form may only be completed by the current record owner of the property and must accompany the corrective or confirmatory deed when sent to the county clerk for recording. The GIT/REP-4 may still be used with the Division's raised seal in lieu of the GIT/REP-4a.
