Dear Associates:

Please find attached an addendum to our memo of June 14, 1993 adding additional names and addressed of properties in Seymour which are currently owned by persons or entities who have been named as defendants in a complaint filed by the Golden Hill PaugussettTribe.

The properties cannot be insured without prior written authorization of Stewart Title Guaranty Company or the insertion of an exception as set forth in our memo of February 16, 1993, to wit:

"Claims to title by the Golden Hill Paugussett Tribe of Indians and/or members of the tribe or those claiming through them."

Also, in clarification of our June 14,1993 memo regarding our prior list as well as this new list, please be advised that where there is currently a Stewart Title Owner or Mortgagee Policy under which the Company remains liable, we will continue to issue policies to any future Owner or Mortgagee without exception to the Indian Claim issue even where the owner has been made a party to an action. To this extent, these properties are not "uninsurable" as previously stated.

For your convenience we are attaching herewith an "Insurability Chart" for your use. Please refer to it whenever you are being asked to insure title in any of the affected towns (Bridgeport, Trumbull, Seymour, Shelton, Monroe and Orange).

Properties Subject to Claims of Golden Hills Paugusett Indians

For commercial property located within affected town:

Call the Stewart office.

For residential property, the following situations will apply:

• Current Owner has Stewart Owner Policy - Property on List or Owner served with Compliant
  
  Issue new Owner or Mortgagee Policy with No Exception as to Indian Claims.
  
  
• Current Owner Refinancing, Purchased Stewart Mortgagee Policy for Current Mortgagee, Property on List or Owner served with Complaint.
  
  Issue Mortgagee Policy with No Exception.
  
  
• Property NOT on list, Owner NOT served with Complaint. but Property located within Affected Town. Affected towns as of July 1, 1993: Bridgeport, Seymour, Shelton, Orange, Monroe, Trumbull.
  
  Issue Policy with the following exception on the Owner Policy:
  
  "Any claim of unmarketability of the insured premises arising out of any claims on the Golden Hill Paugussett Indians in and to the insured premises where any mortgagee of the insured or any contract purchase from the insured or their proposed mortgagee has been offered a commitment to insure over such claims at regular rates, by any title insurance company licensed to do business in the State of Connecticut at date of such application. Stewart Title Guaranty Company agrees, upon request of any mortgagee or purchaser from the Insured, or the proposed mortgagee of any purchaser to issue its Policy of Title Insurance without exception to claims of the Golden Hill Paugussett Indians except as hereinbefore stated."
  
  Issue Mortgagee Policy with No Exception.
  
  
• No Prior Stewart Policy - Property on List OR Owner served with Complaint.
  
  Issue Policy with the following exception on Owner and/or Mortgagee Policy:
  
  "Claims to title by the Golden Hill Paugussett Tribe of Indians and/or member of the tribe or those claiming through them."
