Dear Associates:

Policy Forms

Issue only the 1992 ALTA policies. Do not issue the 1970 ALTA policies. Do not delete any of the policy exclusions.

Standard Exceptions

Standard exceptions must include the following:

  • Those matters reflected by the title examination.
  • Rights or claims of parties in possession not shown by the public records;
  • Easements or claims of easement not shown by the public records;
  • Encroachments, overlaps, boundary line disputes, or other matters which would be disclosed by an accurate survey and inspection of the premises;
  • Taxes or special assessments which are not shown as existing liens by the public records;
  • The liability of the Company by reason of attack, or claim against, or invalidity of the title herein insured, arising out of, relating to, or as a consequence of any alleged, attempted, or factual violation of any of the provisions of Article XII of the Constitution of the Commonwealth of the Northern Mariana Islands, together with the duty of the Company to defend the insured by reason of such an attack or claim, all specifically excepted from the coverage of this policy;
  • Navigational servitudes and all other statutory, regulatory, and littoral rights and powers of the United States of America, the Commonwealth of the Northern Mariana Islands, and other governmental entity and public over lands comprising the beds of oceans, gulfs, or bays and their shore lines extending to the ordinary high-water line thereof, lands beyond the line of the border or bulkhead lines, filled-in lands, submerged lands, or artificial land (where applicable);
  • Any and all rights or claim of rights of the United States of America, the Commonwealth of Northern Mariana Islands, any other governmental entity and the public to that part of the premises in question that constitutes a beach area and all rights of ingress to and egress from said beach area and specifically excluded from the coverage of this policy (where applicable).

Endorsements

You may issue endorsements only in the following cases:

  • You may issue the CLTA Endorsement Form 100 (Comprehensive) on a loan policy covering a single-family residence if you are satisfied as to the coverages in the particular transaction.
  • You may issue the CLTA Endorsement Form 116 (Location) on a loan policy covering a single-family residence if you are satisfied as to the coverages in the particular transaction.
  • You may not issue the CLTA 100 or CLTA 116 in other transactions or on other policies unless you secure approval of underwriting personnel of Stewart Title Guaranty Company.
  • You may not issue other endorsements unless you secure approval of underwriting personnel of Stewart Title Guaranty Company.
