RE: Indiana State Tax Warrants

Dear Associates:

We have recently been advised that each county in the State of Indiana was given a list of state tax warrants dating from 2006 forward that were not previously entered into the county judgment records.  We have also been informed that the tax warrants on the list are being back-dated to the assessment date when they are entered into the county judgment books and electronic records as if the judgments were properly entered at the time of assessment.  We have been told that the Clerks are trying to find a way to remedy this problem.  Indiana Land Title Association industry representatives are also working to resolve this issue.  Until this matter is resolved, you need to include the following exception in all new and pending commitments: 

This policy does not insure against any loss or damage arising out of tax warrant liens filed in the Clerk’s office of (County Name goes here).
