RE: Foreclosures involving Ben-Ezra & Katz Law Firm

Dear Associates:

Fannie Mae recently removed the law firm of BEN-EZRA & KATZ from its foreclosure cases. Fannie Mae has ordered that the foreclosure files being handled by BEN-EZRA & KATZ be transferred to new firms. This, at least for the short term, may cause a major disruption in Fannie Mae cases that were being handled by this firm.

As a result of these recent developments and in addition to the requirements set forth in bulletin SLS2010023, Stewart requires the following for the first sale or mortgage of a property, title to which was obtained by the owner in a foreclosure action brought by BEN-EZRA & KATZ:

Determination by review of the court docket or of the case file that the owners of the property were personally served and the original note was filed in the case.

If it is determined that the owners were not personally served and the original note was not filed, you must secure approval from a Stewart Underwriter to insure.
