RE: Transcript Judgments from Associate Circuit Court

Dear Associates:

The Missouri Office of State Courts Administrator (OSCA) revised its procedures applicable to all Circuit Courts in Missouri. Circuit Courts will no longer open a separate sub-case with the Associate Circuit Court transcribed Judgment if in the same county. Associate Circuit Court judgments transcribed from outside the county will continue to be shown as a sub-case. 

What does this mean to you? An Associate Circuit Court judgment is not a lien against real estate unless and until it is transcribed to the Circuit Court. In order to determine if a same-county Associate Circuit Court Judgment has been transcribed, you will need to look at the Associate Circuit Court case docket for the code JTRAN-Judgment Transcribed. If you find that docket entry, you should except to the lien of the Associate Court Judgment. As always, you must continue to except to the lien of Circuit Court Judgments.

We are advised that the OSCA procedures include February, 2012 updates and modifications to Case.net (https://www.courts.mo.gov/casenet) to display all judgment entries, no matter which court. Stewart will update this Bulletin as more information becomes available.
