RE: Guardian Ad Litem

Dear Associates:

A "guardian ad litem" is appointed by the court to represent and protect the interests of a child or incapacitated person in pending litigation. The powers and duties of the appointed guardian are limited to the litigation itself, and do not extend to conducting the affairs of the ward unless specifically stated in an order of the court that appointed the "guardian ad litem". 

In Washington State appointments of guardians may be made under Title 4, 11, 13 or 26 of the Revised Code of Washington. Guardians appointed under Title 4, 11, 13 or 26 will be "guardians ad litem". Guardians will not have any powers other than those specified in the appointing order. 

Do not insure through documents executed by a "guardian ad litem" without submitting the order appointing the guardian together with all other relevant information to underwriting personnel.
