RE: UNDERWRITING - Survivorship Deeds

Dear Associates:

The District of Columbia Recorder of Deeds (“ROD”) recently announced a change in procedure for recording deeds from a party that has obtained title to the property pursuant to the survivorship provisions of the current vesting deed (either as a surviving joint tenant or tenant in common). The ROD is now requiring the presentation of a death certificate for the deceased prior interest holder before the current owner can record a deed conveying title to the property.   

Due to the fact that these conveyances often occur many years after the death of the prior interest holder, we strongly recommend that you alert the sellers in these transactions as soon as possible of the need to provide a death certificate.
