RE: UNDERWRITING - State of Illinois Lien Registry

Dear Associates:

Effective January 1, 2018, the State of Illinois will no longer record state tax liens at the county level. All state tax liens will be registered in a state maintained database. Pursuant to Public Act 100-0022, once a tax lien is filed in the registry, it will attach to “all of the existing and after-acquired property of the debtor, real or personal, tangible and intangible, which is located in any and all counties within the State of Illinois.”

The database will currently contain only tax liens filed by the Illinois Department of Revenue. It is not known if other state agencies will use the registry for other liens.

Beginning on January 1, 2018, the lien registry can be accessed at tax.illinois.gov. No access fee or signup will be required.

Releases of state tax liens will also be filed in the database.

No state tax liens or releases of state tax liens will be recorded in the county recorder's offices as of December 1, 2017. All state tax liens currently recorded in the county will be released through the registry; no releases of existing state tax liens will be recorded in the county recorder’s offices.
