RE: UNDERWRITING - Miami-Dade Ordinance Section 18-20.2 - Disclosure of Special Taxing District to Purchasers

Dear Associates:

The Miami-Dade County Code has recently been amended to require that sellers of any property located in a special taxing district or proposed special taxing district in the county disclose the special taxing district in which the property is located. The ordinance, Section 18-20.2 (see attached) was passed on February 6, 2018, and takes effect May 17, 2018.

The disclosure must be contained in a prominent location on the face of the deed and acknowledged by the purchaser in the presence of a notary public. The acknowledgment shall read as follows:

I HEREBY CERTIFY THAT I UNDERSTAND THAT THE PROPERTY WHICH IS THE SUBJECT OF THIS TRANSACTION IS LOCATED WITHIN __________________ SPECIAL TAXING DISTRICT CREATED BY MIAMI-DADE COUNTY (OR PROPOSED TO THE BOARD OF COUNTY COMMISSIONERS) FOR THE PURPOSE OF PROVIDING LOCAL IMPROVEMENTS AND SERVICES IN THE NATURE OF _______________.

The Miami-Dade County Property Appraiser’s office or gisweb.miamidade.gov/community services can provide the necessary information as to which taxing district the property is in if you are unable to determine it from the contract or listing agreement. It is unclear what the penalties may be from failing to comply with the ordinance. It is possible that the deed may not be accepted for recording.
