RE: RATES AND/OR FORMS UPDATE - Davidson County Tennessee abstract rate

Dear Associates:

The Tennessee Department of Commerce and Insurance rules and regulations require every title insurance company, which proposes to do business in any county in this state having a population of more than 700,000, as reported by the Federal Census, to file a schedule of rates for “abstracts of title”. The recent Federal Census places Davidson County in this category.

The filing of this abstract rate does not change the Davidson County rate table which recently went into effect.

Stewart’s Rate Manual now identifies Davidson County, with a new Schedule G, the Schedule for abstract of title charges is identified in Schedule G-1 as listed below:

Commercial ....................................................... $300.00 + $5.00 per recorded instrument

Additional charges may be made for searches involving complex or time-consuming matters, more than one chain of title or extraordinary risks, copies of documents, etc.

Abstracts of Title Original charges:
Residential 1-4 ...................................................  $125.00
Commercial………………………………………… $300.00 + $5.00 per recorded instrument

0780-1-12-.01 DEFINITIONS
(3) “Abstract of title” means a history of title to real property or an interest therein for a given period of time consisting of a listing, summary, copy or some combination thereof of documents or matters affecting said title and imparting constructive notice under the laws.

0780-1-12-.02 FILING OF RATES
(2) On April 1, 1995, every title insurance company which proposes to do business in any county in this state having a population of more than 700,000, as reported in the 1980 Census or any subsequent census, shall file with the Commissioner a schedule of rates for abstracts of title, however denominated, to be made in contemplation of the issuance of each and every commitment, binder or policy of title insurance to be issued by the company, its title insurance agencies or its title insurance agents in insuring title to real property located in such county, whether such abstracts of title be made from a title plant or from the public records.
