RE: UNDERWRITING - Fourth Amended and Restated Mutual Indemnification Agreement

Dear Associates:

The Fourth Amended and Restated Mutual Indemnification Agreement ("Agreement") became effective on February 1, 2023. The Agreement supersedes the Third Amended and Restated Mutual Indemnification Agreement which became effective on December 15, 2022.

Please note that five additional companies elected to participate in the Agreement:

  • Chicago Title Insurance Company
  • Commonwealth Land Title Insurance Company
  • Fidelity National Title Insurance Company
  • First American Title Insurance Company
  • Title Resources Guaranty Company

Agents therefore may rely on a current owner’s policy to insure over certain title defects without the need of requesting a letter of indemnity provided they have a copy of the current owner’s policy issued by one of the following title insurance companies:

  • Alliant National Title Insurance Company
  • AmTrust Title Insurance Company
  • Chicago Title Insurance Company
  • Commonwealth Land Title Insurance Company
  • Connecticut Attorneys Title Insurance Company
  • Doma Title Insurance Company
  • Fidelity National Title Insurance Company
  • First American Title Insurance Company
  • First National Title Insurance Company
  • Investors Title Insurance Company
  • Old Republic National Title Insurance Company
  • Stewart Title Guaranty Company
  • Title Resources Guaranty Company
  • Westcor Land Title Insurance Company
  • WFG National Title Insurance Company

Stewart Title recommends that all agents review the Mutual Indemnification Agreement carefully as it only provides indemnification for certain defects that fall within the specific guidelines set forth. If a title defect is not covered by the Agreement, you must contact your underwriter who will determine appropriate underwriting requirements.
