RE: UNDERWRITING - City of Denver Solid Waste

Dear Associates:

The City of Denver has a new ordinance regarding solid waste (trash). If solid waste bills are not paid, they are eligible for a lien similar to Wastewater Storm Drainage. This change went into effect in January 2023.

Offices that are performing Escrow services are advised to comply with the following process on any transaction involving land located within the City and County of Denver, Colorado.

Process for Denver Solid Waste - Obtaining Status and Transferring of Service (Trash) 

  • Contact information for Denver Solid Waste is: 
    • Call 303-446-3500 – Denver WasteWater Management and request to be transferred. Denver Solid Waste & Denver WasteWater are in the process of training employees to be able to answer questions/provide status for both products.
    • Email address: swm.titlecompany@denvergov.org - you can also request status and transfer via the email address, be sure to include the following: Tax Schedule Number, property address, buyer name and forwarding address as well as the transfer date (closing date)
    • Billing address: Check should be payable to Manager of Finance and mailed to, City and County of Denver, PO Box 73564, Dallas, TX 75373-5644. Be sure to reference the account number on the check.
  • Billing for Denver Solid Waste will follow a similar timeline as Denver WasteWater. If you contact Denver Solid Waste, and the Seller has not been billed yet, as the billing cycle has not started, then no funds will be due until the billing cycle starts. It is recommended that this information be checked again as close to the closing date as possible.

Additional information regarding the Ordinance is provided for informational purposes only:

  • Once the Denver Solid Waste is past due by at least 90 days and an amount past due of at least $200, the delinquent bill will be turned over and certified to Denver County Treasurer and a Service Lien will be recorded with the Denver County Clerk and Recorder.
  • If delinquent amount is paid within the same calendar year to Denver County Treasurer:
    • The Treasurer will remit payment to Denver Solid Waste
    • Denver Solid Waste will release recorded lien
  • If delinquent amount is NOT paid within the same calendar year to Denver County Treasurer, the amount will be added to the annual property tax statement. Once annual taxes are paid then:
    • The Treasurer will remit payment to Denver Solid Waste
    • Denver Solid Waste will release recorded lien
  • Should the annual taxes not be paid, then the normal Tax Sale process will be followed. 
    • Upon sale of the property at Annual Tax Sale then:
      • The Treasurer will remit payment to Denver Solid Waste
      • Denver Solid Waste will release recorded lien
