RE: RATES AND/OR FORMS UPDATE - NEW FORMS AND RATES APPROVED

Dear Associates:

The following new rates and forms are now available for use in Indiana effective APRIL 14, 2023:

NEW FORMS FILED:

  • ALTA 23.1 Coinsurance Multiple Policies 5-12-22
  • ALTA Residential Limited Coverage Junior Loan Policy (4-2-22)
  • ALTA Residential Limited Coverage Mortgage Modification Policy (4-2-22)
  • ALTA Short Form Residential Limited Coverage Junior Loan Policy (4-2-22)
  • ALTA Endorsement JR 1 (4-2-22)
  • ALTA Endorsement JR 2 (4-2-22)
  • ALTA 48 Tribal Waivers and Consents 4-2-22
  • STG Multiple Foreclosure Endorsement 1-23-23
  • ALTA Loan Policy of Title Insurance, Schedule A, BI, BII (7-1-21) - This form was originally filed and approved in 2021, but it did not include a Schedule A with item #6. The version approved in this filing includes item #6 so that the option to incorporate a list of endorsements is now available.

FORMS REMOVED IN THIS FILING:

A set of 2021 ALTA Policy forms without arbitration was withdrawn because arbitration is permitted in Indiana. The set of policies with arbitration were recently approved and are currently effective. The forms removed in this filing include the following:

  • ALTA Commitment Without Arbitration 7-1-21
  • ALTA Owner's Policy of Title Insurance Without Arbitration 7-1-21
  • ALTA Loan Policy of Title Insurance Without Arbitration 7-1-21
  • ALTA Homeowner's Policy of Title Insurance Without Arbitration 7-1-21
  • ALTA Expanded Coverage Residential Loan Policy - Assessments Priority Without Arbitration 7-1-21
  • ALTA Expanded Coverage Residential Loan Policy - Current Assessments Without Arbitration 7-1-21

NEW RATES FILED:

A revised rate manual will be available at www.stewart.com/Indiana.

The following is a summary of the changes to the rate manual.

  • The Homeowner’s Policy of Title Insurance has been updated to reflect a rate of 110% of the recommended Residential Standard Owner’s Policy rate with a minimum charge of $198.00.
  • The Residential Standard Loan Policy minimum has been decreased to $75 from $100.
  • The Simultaneous Issue charge for residential transactions has been increased to $100 from $50.
  • The rate for the Jr. Loan Policy has been increased to $100 from $75.
  • Residential endorsements will increase from no charge to $50 per endorsement with limited exceptions.
  • The minimum charge for the Commercial Loan Policy has been increased to $525 from $500.
  • The Simultaneous Issue charge for commercial transactions has been increased to $250 from $225.
  • Commercial endorsement charges changed from standard and extra-hazardous with minimum/maximum charges to a mix of flat charges and percentage of liability based on standard/hazardous qualifications.
  • The charge for the deletion of the Mechanic’s Lien exception changed from a percentage of liability calculation with a maximum of $600 to a flat rate of $500.
  • The ALTA Limited Pre-Foreclosure Policy will have the same rates as the Standard Loan Policy.
