RE: RATES AND/OR FORMS UPDATE - New and Revised ALTA Forms - Effective January 2, 2025 [Revised 2-3-25]

Dear Associates:

The American Land Title Association (ALTA) recently adopted new/revised forms, effective January 2, 2025. The new/revised endorsements are below.

The new/revised forms are available on Virtual Underwriter in the ALTA Forms List. Per ALTA, the new/revised endorsements provide the following coverages and/or include the following revisions:

REVISED ALTA ENDORSEMENT

ALTA 48 Endorsement – Tribal Limited Waiver and Consent Endorsement (01- 02-2025): This revision of the ALTA 48 Endorsement addresses questions that have been raised as to purpose and scope of the original version of the endorsement.

NEW ALTA ENDORSEMENTS

ALTA 48.1 Endorsement – Tribal Limited Waiver and Consent Agreement (01- 02-2025): The ALTA 48.1 Endorsement provides the option of a separate sovereign immunity waiver agreement between an underwriter and the tribal entity to be incorporated by reference into the Policy.

ALTA 36.9 Endorsement – Energy Project – Minerals and Other Subsurface Substances – Land Under Development (01-02-2025): This endorsement provides coverage for the enforced removal or alteration of an Electricity Facility or Severable Improvement that is built according to the Plans, where the loss or damage results from the future exercise of any right existing at Date of Policy to use the surface of the Land to extract or develop excepted minerals or other subsurface substances. NOTE: This endorsement is not available in Oklahoma.

ALTA 22.2 Endorsement – Land Address (01-02-2025): This new endorsement provides coverage for loss or damage if the Land is not known by a specific stated address within the records of a specified entity.

TECHNICAL CORRECTIONS

ALTA JR1 Endorsement (TC 01-02-2025): The technical corrections to the ALTA JR1 Endorsement include the following revisions:

  1. Changing the format on a drafting instruction to comply with current standards (Paragraph 3);
  2. Adding two additional drafting instructions for clarity (Paragraph sections 4.a. and 4.b.);
  3. Removing an extra period on two different Roman numerals (lowercase) (Paragraph sections 4.a.ii. and 4.b.ii.).

If requested by the customer, the new/revised ALTA forms are immediately available for use in Colorado, Illinois, Iowa, Massachusetts, Mississippi, Oklahoma (except the ALTA 36.9), and Tennessee. In states where form and/or rate filings are required, we will distribute subsequent state-specific bulletins as these forms become available.

As a reminder, other forms should not be used if a comparable ALTA version is available. If a comparable ALTA version is available, the most current version of the ALTA form available in your state should be used, unless approved by a Stewart Title Guaranty Company underwriter.

These forms have been provided to third-party title production system (TPS) vendors. Please contact your TPS vendor or account services representative to have the new/revised forms implemented in your system.
