Dear Associates:

Over the last several years there have been an increasing number of incidents which have delayed or prevented County Clerk’s offices from either providing up-to-date title information and/or recording real property instruments. The underwriting guidance that Stewart Title Guaranty Company (STGC) can provide in each such circumstance is based on the actual facts at the time. In order to assist us in providing this guidance, please report such incidents to an STGC Texas underwriter and provide us with as much of the following information as you can reasonably obtain:

- What type of incident is involved (e.g., cyber-attack, data breach, infrastructure interruption,    etc.)?
- What systems are affected (e. g. searching and/or recording)?
- How current is the information that is available (e.g., what date are searches currently available through)?
- Does it affect both in person and electronic access (i.e., is online access affected, is a real-time stand-up examination available, is electronic recording affected, is in person recording available)?
- What steps have been taken by the Clerk’s office as a work around (e.g., in person recording with manual time and date stamps is implemented until online recording is restored)?
- Can the County provide any timeline for restoration or partial restoration of the affected systems?
- Any other information you obtain related to the situation.
