Upon the representation and assurance by the Insured, THE DEPARTMENT OF VETERANS AFFAIRS OF THE STATE OF CALIFORNIA, that the Insured has advanced to the sum of $ and that the Agreement referred to in Schedule A has been modified to provide for such advance, the Company hereby insures the Insured against loss that the insured sustains by reason of:

1. Title to the estate or interest referred to in Schedule A being vested according to the Public Records, at the Date of Endorsement, other than in The Department of Veterans Affairs of the State of California, as to the legal title, and

as to the equitable title created by the Agreement [and the assignment thereunder] referred to in Schedule A [and an assignment thereunder recorded __ in the Public Records], except as affected by the following instruments:

2. Any defect, lien or encumbrance shown in the Public Records at the Date of Endorsement that is not shown or referred to in a Schedule B exception or otherwise excluded from the coverage of this policy, except:

The total liability of the Company under the policy and any endorsements therein will not exceed, in the aggregate, the Amount of Insurance, plus the amount of said additional advance, and costs that the Company is obligated under the policy Conditions to pay.

This endorsement is issued as part of the policy.  Except as it expressly states, it does not (i) modify any of the terms and provisions of the policy, (ii) modify any prior endorsements, (iii) extend the Date of Policy, or (iv) increase the Amount of Insurance.  To the extent a provision of the policy or a previous endorsement is inconsistent with an express provision of this endorsement, this endorsement controls.  Otherwise, this endorsement is subject to all of the terms and provisions of the policy and of any prior endorsements.
