Explanation:

Assurance is given that according to the company's property records (but without reference to those records indexed by name) there are no specified instruments affecting the land subsequent to a stated date (to be filled in) other than those listed as exceptions. The Guarantee may be made broad enough to include all instruments affecting the land or it may be tailored to include only particular kinds of documents.

The following matters are specifically excluded from coverage:

(1) Unpatented mining claims, reservations or exceptions in patents or in acts authorizing the issuance thereof;
(2) Water rights, claims or title to water;
(3) Tax Deeds to the State of California;
(4) Instruments, proceedings or other matters which do not specifically describe the land.

Do not use this Guarantee on the Lot Book Guarantee for environmental due diligence searches on commercial land. You should use only the Recorded Document Guarantee in that circumstance.

The Guarantee Face Page (revised 6-6-92) and Guarantee Conditions and Stipulations (revised 6-6-92) must be used with the Plant Information Guarantee Schedule A.

Any revision to this form requires approval of a Stewart Title Guaranty Company underwriter. The underwriting guidelines contained herein have been provided for general reference. The facts, circumstances, and location of the subject property should be considered when determining the issuance of the requested form or endorsement. Please note that all of the forms and endorsements included in this system may not be available in all states. Accordingly, please contact the appropriate Stewart Title Guaranty Company underwriting personnel in order to determine availability.

Compliance with the underwriting guidelines contained herein in no way obligates Stewart Title Guaranty Company to issue any form or endorsement.
