The holder of a tax deed takes the title of the taxpayer and receives at least constructive possession of the land described in the deed. The tax deed obliterates all prior encumbrances, except those based upon taxes.

If the sale is invalid, the statutes provide that whether after tax sale or tax deed the county will reimburse the tax title holder plus statutory interest from the date of the tax sale.
