In General

While a written application for a title insurance policy is always desirable, the Company does not consider it indispensable that a written application on a company form be obtained.

Requests by letter or telephone are often acceptable as applications for title insurance.

Nevertheless, it is preferable to require a written application from the proposed insured where:

  • There is a request to insure a mortgage that has been on record for a certain period of time; or,
  • There is a request to insure a mortgage on land that was acquired some time ago and which is not the subject of any current transaction. See Owners in Possession.

A title insurance application should be examined very carefully because on occasion it can reveal information or knowledge not imparted by the public records.
