The Company hereby insures the owner of the indebtedness secured by the insured mortgage against loss or damage which the insured shall sustain by reason of:

(1) The failure of the foundation of the structure under construction on that portion of the land described as:

to be within the boundary lines of the above described portion of the land as of the date hereof;

(2) The location of the foundation as of the date hereof, being in violation of the covenants, conditions or restrictions referred to in Schedule B;

(3) The foundation encroaching as of the date hereof, onto any of the easements referred to in Schedule B.

The liability of the Company under this endorsement shall not exceed the sum of $ ___________________ and costs which the Company is obligated to pay under the Conditions and Stipulations of the policy; and the total liability of the Company under the policy and any endorsements thereto shall not exceed, in the aggregate, the face amount of the policy and costs which the Company is obligated to pay under the Conditions and Stipulations.
