Notwithstanding Exception _______ in Schedule B of the policy, the Company insures against loss or damage sustained by the Insured by reason of the lack of priority of the lien of the Insured Mortgage over any lien for services, labor, material or equipment affecting the Title and arising from construction of a work of improvement on the Land, but only to the extent that such lien is for services provided, labor performed, or materials or equipment furnished prior to <fill in the date through which the mechanics lien coverage is currently being provided>________________________(the “Mechanics Lien Coverage Cut-Off Date”).

This endorsement is issued as part of the policy.  Except as it expressly states, it does not (i) modify any of the terms and provisions of the policy, (ii) modify any prior endorsements, (iii) extend the Date of Policy, or (iv) increase the Amount of Insurance.  To the extent a provision of the policy or a previous endorsement is inconsistent with an express provision of this endorsement, this endorsement controls.  Otherwise, this endorsement is subject to all of the terms and provisions of the policy and of any prior endorsements.

<CLTA Form 122.1A-06:  Information Page – The following Schedule B Exception must be included in the Preliminary Report/Title Commitment and the Loan Policy in tandem with the issuance of the CLTA 122.1A:

Any lien for services, labor, material or equipment that arises from services provided, labor performed, or material or equipment furnished on or after (the “Mechanics’ Lien Coverage Cut-Off Date.”) 

Note: the “Mechanics’ Lien Coverage Cut-Off Date” shown in the above-referenced Schedule B exception must be the same as the “Mechanics’ Lien Coverage Cut-Off Date” shown in the CLTA 122.1A endorsement issued with the policy.>
