Some historical land records contain Discriminatory Covenants that are illegal and unenforceable by law. This policy treats any Discriminatory Covenant in a document referenced in Schedule B as if each Discriminatory Covenant is redacted, repudiated, removed, and not republished or recirculated. Only the remaining provisions of the document are excepted from coverage.

In addition to the Exclusions from Coverage, this policy does not insure You against loss or damage and We will not pay costs, attorneys’ fees, or expenses resulting from the terms and conditions of any lease or easement identified in Schedule A, and the following matters:

1.            Those taxes and special assessments imposed by government authority, including any additional taxes and/or penalties resulting from any reassessment, which become due and payable subsequent to the Policy Date.

2.            Covenants, conditions, restrictions, easements and/or servitudes.  This does not impair the coverage afforded under Paragraph 8(e), 12, 13, 23, 24 and 26 of the Covered Risks.

3.            Any lease, grant, exception or reservation of minerals or mineral rights.  Nothing herein shall insure against loss or damage resulting from subsidence.  This does not impair the coverage afforded under Paragraph 25 of the Covered Risks.

4.            Any mortgage, deed of trust, security deed or other encumbrance, whether or not appearing in the public records, which was created by, assumed, or agreed to by an Insured.

5.            All matters depicted on the plat of survey of the land described in Schedule “A” which may be attached hereto, and if so attached is thereby made a part hereof.  This does not impair the coverage afforded under Paragraph 12, 13, 23, 24 and 26 of the Covered Risks, unless such matters are specifically set out below:
