Parks

If the land has been dedicated as a park, you must require releases from all subdivision owners and their lienholders (since these parties may have easements or enforceable covenants in the land), and a release from the municipality (subject to a possible election requirement before it can release its rights) or you must make an exception.

Remove Park Dedication

The Company requires for its review and recordation satisfactory conveyances or releases executed by the dedicator, all the record owners, parties in interest, and encumbrances of lots in the subdivision. The Company requires proper abandonment of the dedication in favor of the public as provided by applicable law.
Comment: If the land has been dedicated as a park, you must require releases from all subdivision owners and their lienholders (since these parties may have easements or enforceable covenants in the land), and a release from the municipality (subject to a possible election requirement before it can release its rights) or you must make an exception.

Parks and Related Easements

The land is subject to dedication for park purposes only and is subject to implied and express easements for and restrictions to such use.
Comment: If the land is dedicated as a park, or shown as a park on a subdivision map or plat, you must add this exception unless the dedication and related rights are properly released.
