When insuring title based upon a judgment, order, or decree (e.g., vesting title, ordering sale, ordering foreclosure) that is not yet final and nonappealable, you must require that the appeal period lapse or make an exception to lack of finality. Every new title policy must include a Schedule B exception to pending litigation that affects property described in Schedule A. Pending litigation includes every possible appeal, motion to vacate, motion for rehearing etc.

Any deviation from the above must be specifically approved by the National Legal Department.
